To the fullest extent permitted by applicable law, abg365 shall not be liable for any direct, indirect, incidental, consequential, or punitive losses arising from:

• Unauthorised access to your account resulting from your failure to protect your credentials.

Nothing in these Terms shall limit abg365's liability for fraud, wilful misconduct, or any other liability that cannot be limited or excluded under applicable law.

Where an account is closed by abg365 due to a breach of these Terms, any balance held in the account may be withheld pending the outcome of an investigation. If the investigation confirms a material breach, abg365 reserves the right to forfeit all or part of the account balance.

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms or your use of the abg365 Platform shall first be referred to the abg365 support team at [email protected] for resolution. abg365 will endeavour to resolve any dispute within 14 calendar days of receipt of a written complaint.

If a dispute cannot be resolved through the internal complaints process, the parties agree to submit to the exclusive jurisdiction of the competent courts applicable in the relevant jurisdiction.
